These Terms of Service ("Terms") govern your access to and use of the Cretac.ai document processing platform ("Service") operated by Cretac.ai ("Cretac", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Service Description

Cretac.ai provides an AI-powered document processing platform that extracts structured data from uploaded documents (PDFs, images) according to user-defined templates and rules. The Service includes document upload, OCR processing, AI-driven data extraction, approval workflows, and data export.

3. User Accounts

• You must create an account using Google OAuth to access the Service.
• You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• You must promptly notify us at hello@cretac.ai if you become aware of any unauthorised access to your account.

4. Acceptable Use

You agree not to:

• Upload documents containing illegal content or content that violates third-party rights
• Attempt to circumvent access controls, rate limits, or security measures
• Use the Service to process documents on behalf of others without their consent
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated scripts to access the Service in a manner that degrades performance for other users

5. Your Data

You retain full ownership of all documents you upload and all data extracted from them. We do not claim any intellectual property rights over your content. We process your data solely to provide the Service as described in our Privacy Policy.

You are responsible for ensuring you have the right to upload and process the documents you submit to the Service.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

7. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Cretac.ai and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand assets without prior written consent.

8. Free and Paid Plans

The Service is available under a free tier for individual users and paid enterprise plans for teams. Feature availability and usage limits vary by plan. We reserve the right to modify plan features and pricing with 30 days' notice to affected users.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from these Terms or the Service shall not exceed the fees you paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.
• We are not responsible for the accuracy of AI-generated extractions. You are responsible for reviewing and verifying extracted data before relying on it for business decisions.

10. Termination

You may close your account at any time by contacting us at hello@cretac.ai. We may suspend or terminate your access if you violate these Terms, with notice where practicable. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the application at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
